Archtip Inc. (“Archtip”, “we”, “our”, or “us”) operates Nivela.ai, the world’s first AI sales rep for building materials suppliers. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you access our website or use our platform (together, the “Services”). Capitalized terms not defined in this policy have the meanings provided in the Services Agreement.

1. Information We Collect.

1.1. Information You Provide. We collect information you provide directly to us when you register for an Account, subscribe to a plan, or communicate with us. This includes:

  • Name and email address
  • Company name and job title
  • Payment information, including billing details (processed securely by Stripe; see Section 4.1)
  • Account credentials
  • Any other information you submit through the Services

1.2. Information Collected Automatically. When you access the Services, we and our service providers may automatically collect certain technical and usage information, including:

  • Log data, such as IP address, browser type, pages visited, and date and time of access
  • Usage and analytics data, including feature interactions and session duration
  • Device information, including operating system and browser version
  • Information collected through cookies and similar tracking technologies (see Section 5)

2. How We Use Your Information.

We use the information we collect to:

  • Create and manage your Account and deliver the Services
  • Process payments and send billing and transactional communications
  • Respond to your inquiries and provide customer support
  • Send product updates and, where permitted, marketing communications (you may opt out at any time)
  • Analyze usage patterns and improve our platform and Services
  • Detect, investigate, and prevent fraud, abuse, or security incidents
  • Comply with applicable legal obligations and enforce the Agreement

3. Sharing Your Information.

We do not sell your personal information. We may share your information with third parties only in the following circumstances.

3.1. Service Providers. We share data with trusted third-party vendors who assist us in operating our business and delivering the Services. These include:

  • Stripe. Payment processing. Stripe’s privacy practices are available on their website
  • Intuit. Customer relationship management. Intuit’s privacy practices are available on their website
  • Analytics providers to help us understand and improve platform usage

Service providers are contractually obligated to use your data only to perform services on our behalf and to maintain appropriate confidentiality and security standards.

3.2. Legal Requirements. We may disclose your information if required by applicable law or in response to valid legal process, including court orders or requests from governmental authorities. Where permitted, we will use reasonable efforts to notify you prior to such disclosure.

3.3. Business Transfers. If Archtip is involved in a merger, acquisition, financing, reorganization, or sale of all or substantially all of its assets, your information may be transferred as part of that transaction. We will provide notice before your personal information becomes subject to a materially different privacy policy.

3.4. With Your Consent. We may share your information for any other purpose with your prior consent.

4. Cookies and Tracking Technologies.

We use cookies and similar technologies to operate and improve the Services, analyze usage, and support our marketing activities. The types of cookies we use include:

  • Essential cookies — required for the Services to function correctly
  • Analytics cookies — help us understand how users interact with the Services
  • Preference cookies — remember your settings and account preferences

You may control cookie preferences through your browser settings. Disabling certain cookies may affect the functionality of the Services. Where required by applicable law, we will obtain your consent before placing non-essential cookies.

5. Data Retention.

We retain your personal information for as long as your Account is active or as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. When you delete your Account, we will delete or anonymize your personal information within ninety days, unless retention is required by law or as otherwise permitted under the Agreement.

6. Security.

We implement industry-standard technical and organizational measures designed to protect your personal information against unauthorized access, disclosure, alteration, or destruction. Payment information is processed exclusively by Stripe and is not stored on our servers. While we take reasonable precautions, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security of your information.

If we become aware of a security incident that affects your personal information, we will notify you in accordance with applicable law.

7. Your Rights.

Depending on your location, you may have rights regarding your personal information. We will respond to verified requests within thirty days, subject to applicable law.

7.1. General Rights. Subject to applicable law, you may have the right to:

  • Access — request a copy of the personal information we hold about you
  • Correction — request that we correct inaccurate or incomplete information
  • Deletion — request that we delete your personal information, subject to our legal obligations
  • Portability — request that we provide your data in a portable, machine-readable format
  • Opt-out — unsubscribe from marketing communications at any time by following the unsubscribe instructions in our emails or by contacting us at the address in Section 11

7.2. Canadian Residents (PIPEDA). If you are a resident of Canada, your personal information is protected under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. You have the right to access your personal information held by us and to challenge its accuracy. To exercise these rights, please contact our Privacy Officer at the address set out in Section 11.

7.3. U.S. Residents. Residents of certain U.S. states, including California under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), may have additional privacy rights. We do not sell personal information, as that term is defined under applicable U.S. state privacy laws. If you have a request specific to your state privacy rights, please contact us and we will respond in accordance with applicable law.

8. Children’s Privacy.

The Services are not directed to individuals under the age of 16, and we do not knowingly collect personal information from children under that age. If we become aware that we have inadvertently collected personal information from a child, we will take steps to delete it promptly. If you believe we may have collected information from a child, please contact us at the address in Section 11.

9. Changes to This Policy.

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the revised policy on our website and updating the effective date at the top of this document. For significant changes, we will provide additional notice by email or through a prominent notice on the Services. Your continued use of the Services after the effective date of any update constitutes your acceptance of the revised policy. If you do not agree with an update, you may stop using the Services.

11. Definitions.

“Account” means an administrative account provided to you by Nivela for the purpose of accessing the Services.

“Agreement” means the Services Agreement between you and Nivela, as amended from time to time.

“Personal Information” means any information about an identifiable individual, as defined under applicable privacy legislation.

“Services” means Nivela’s platform and associated software, tools, and website made available to customers, as further described in the Agreement.
